John Emery was born in Missouri in 1902, a year before the Wright brothers would make the first controlled airplane flight near Kitty Hawk, N.C. His father, a New Englander, built and sailed clipper ships.Mr. Emery learned about transportation and the vagaries of the bottom line early as an employee of the financially ailing Chicago & Alton Railroad. The line, which went into receivership in 1922, lost its top commodity, the lucrative cattle trade out of Kansas City, with the development of the Chicago Union stockyards. The lessons governing the needs of shippers and how best to respond to them would be the cornerstone of the air cargo business Mr. Emery started after World War II. Before World War II, and after a stint as editor of Railway Age magazine and as an assistant to Joseph Eastman, then federal coordinator of transportation, Mr. Emery joined the Railway Express Agency. He was at REA negotiating trucking contracts when the war began. One of his first assignments was to arrange the contract under which REA would supply trucking services for the Naval Air Transport Service. The Navy was so impressed by his skills they asked Mr. Emery to come on board and help set up the Navy's new traffic department. Newly commissioned Lt. Cmdr. John C. Emery was named executive commander of the Navy's Transportation Division. ''Our job was to act as the forwarder for the Navy's wartime, worldwide airline,'' Mr. Emery would tell The Saturday Evening Post in a 1955 interview. The cargo ranged from whole blood for South Pacific jungle hospitals to guns for battleships in the Mediterranean fleet. ''We picked up the freight from its source, gave it a priority and a routing, then got it on the right carrier. We followed it to its destination and there off-loaded it and delivered it to the final user,'' Mr. Emery told the magazine. While regular air express shipments were known in the 1930s, it was not until the war and the introduction of the four-engine C-54, with its wide doors and large cargo space, that heavy-duty air lifts for freight became commonplace. It was left to Mr. Emery's transportation division to pioneer the logistics of air cargo lifts for the Navy. It devised special packaging and crating, and a control system to ensure that freight was always moving through the system. THE COMPANY TAKES WING When John Emery left the service in 1945, he was determined to take what he had developed for the military and turn it into a civilian air cargo operation. With the aid of some military buddies and some neighbors in Connecticut, he founded Emery Air Freight Corp. in April 1946. Raising funds for the new company proved relatively easy. Leonard Hunt, one of the original investors and the company's first vice president, would recall in an interview that Wall Street investment firms had no trouble raising the $285,000 needed in start-up funds. ''The stock was subscribed to immediately. In 1946, the public was ready for anything with the word 'air' in it,'' he would say in an interview given to mark the company's 10th anniversary. Reluctantly, John Emery used his own name for the company, on the theory that he would be unlikely to run into similarly named competitors than if he had tried to register the company in all 48 states under a more generic name. In 1946, he became the first air freight forwarder to apply for a license from the Civil Aeronautics Board as a common carrier. While he envisioned his company in partnership with scheduled airlines, the airlines considered a freight forwarder with common carrier status as a competitor. They fought Emery's license application at every turn, and it wasn't until 1948 that the CAB finally granted Emery common air freight carrier license No. 1. In the interim, as Emery's cash reserves dwindled to just over $100,000, the company operated out of a New York office. Its modest fleet of vehicles consisted of two Ford ''woody'' station wagons, one driven by Mr. Emery's son, John C. Emery Jr. One of the company's first contracts was with the Federal Reserve Bank of New York. They got the contract when Railway Express went on strike. John C. Emery Jr., in an interview for this article, said initial shipments called for someone to open a window at the New York office, whistle for the driver, who would catch a bag of bank checks to be delivered to Cleveland. The young Mr. Emery, often the one waiting below at the curbside loading dock, would then drive to the airport as fast as he could and place the bag on the first flight he could find that stopped in Cleveland. The first year the company lost $94,000. ''A good portion of that went for the speeding tickets I collected racing to the airport,'' laughed Mr. Emery, who would serve for 41 years with the company his father founded, including 20 as its president. Good times, bad times Laughing is easier now for John Emery Jr., eight years after he would sever the financial ties with the company that still bears the family name. ''I made some mistakes that would come back to haunt the company,'' he admitted frankly. Long before John Emery Jr. would take control, his father was still pushing the air freight company to new heights. In 1956, Emery Air Freight opened its first overseas office, in London. By 1969, the company had risen to the top of its field. It moved to the cutting edge of technology with a computerized tracking and tracing system called Emcon, short for Emery Control. The system was capable of tracking a shipment in real time, updating shippers on the progress of their freight from point of pick up to delivery. On Nov. 15 of that year, John Emery died of heart failure at 67. Two days later, his old financial partner, Leonard Hunt, succumbed to cancer. A new era was about to be begin for Emery Air Freight with the loss of two of its guiding lights. The deaths of John Emery Sr. and Leonard Hunt would not be the only shadows to fall over the company. Two events would occur within six months in 1973 to change the face of air cargo. In April, Frederick W. Smith, using an idea of an overnight delivery business he had first conceived as an undergraduate at Yale University, started Federal Express. In late October of that same year, gasoline prices skyrocketed after Arab nations placed an embargo on oil imports to the United States in retaliation for U.S. aid to Israel in the Yom Kippur War. The subsequent fuel crisis dramatically increased the cost of airline operations. In response, some carriers curtailed and even discontinued flights to certain cities. For Emery, the cutbacks meant limiting delivery service for many customers. To offset the problem, Emery began leasing its own planes. Emery Air Force hit the skies in 1976, beginning the carrier's closed loop system. The company now controlled freight from pickup to delivery, with Emery trucks and aircraft overseeing every step. The new aircraft also marked a new debt load for Emery. Fred Smith, meanwhile, was carving out a niche for Federal Express in the small package field, offering door-to-door service with its own trucks and airplanes. Initially classified as an ''air taxi'' by the Civil Aeronautics Board, Federal Express could only use small aircraft. Still, Emery's board considered FedEx enough of a threat to consider buying the company for $5 million. Whether it was to be incorporated into Emery or merely shut down remains unclear. John Emery Jr., a conservative manager overseeing a fiscally conservative executive board, rejected the proposal. The thinking was why pay $5 million to kill FedEx when the company would probably fail under its own weight? ''Understand, these were decisions being made before there was any talk of deregulation. Deregulation changed everything,'' Mr. Emery said. The Airline Deregulation Act of 1978 began the legislative process that would change the face of the airline industry, making it easy for new companies enter the business. Deregulation allowed Federal Express to grow its hub-and-spoke delivery system and clear the way for its purchase in 1989 of certified cargo carrier Flying Tiger Line Inc. The merger placed Federal Express, the small-package carrier, into the air freight business. John C. Emery Jr. was also trying to expand his business. Unfortunately, an acquisition that looked good on paper would nearly kill his company and eventually take it from family hands. In 1987, Emery purchased Purolator Courier for $306 million. ''I anly saw the upside,'' John Emery told AirCommerce in a telephone interview from St. Thomas, U.S. Virgin Islands. ''I saw us adding a huge chunk of business without having to add planes or facilities.'' ''Emery wanted exposure to the small package market. What they got was thrown into a meat grinder with Federal Express and Airborne chewing them up,'' said industry analyst and consultant Mark B. Solomon in Atlanta. Within two years, despite closing terminals to cut costs and improve efficiency, Emery was on the verge of shutting down. To the rescue rode Consolidated Freightways Inc. The U.S. Justice Department, which approved the merger despite concerns over possible monopoly pricing, gave its OK after determining no other white knight was on the horizon, and that Emery, failing completion of the pending merger, would cease to exist within ''days or hours.'' CF TURNS THE CORNER In 1989, CFI bought Emery for $230 million, $76 million less than Emery had paid just two years earlier for Purolator. Consolidated Freightways combined Emery with its own C.F. Air Freight on April 17, 1989, and ''Emery Worldwide - a CF Company,'' was in business. The assimilation of Emery into CF was not without its problems. Art Bass, a former Federal Express official, was put in charge of Emery. The company, still trying to be all things to all people, stumbled coming out of the gate. Emery was quickly earning a reputation for being in the middle of the pack for both rates and reliability, a deadly combination. Competition was also picking up, with UPS flying its own planes and DHL and TNT, both small package specialists, now firmly entrenched in the domestic market. With Wall Street watchers describing Emery as an albatross around CF's neck, the parent company placed a new management team at the helm in 1991. Roger Curry, who had been president of C.F. Air Freight before the merger, was installed as Emery's president in March 1991, and he immediately set out to put the carrier back on track as a heavy freight industry company. Reducing the size of the company's fleet and getting out of the document business, he focused on the heavy back door freight business. Mr. Curry, who would move back up the corporate ladder at CF, was replaced as president and chief executive of Emery Worldwide in July 1994 by David I. Beatson. Mr. Beatson, who had worked for Mr. Curry at the old C.F. Air Freight, was coaxed back to the fold from American Airlines, where he served as cargo director. One of his first coups was helping Emery secure a 10-year, $10 billion contract with the U.S. Postal Service. Today, he oversees the $1.6 billion global air freight, ocean forwarding and logistics services company whose assets include a fleet of 92 aircraft, 2,000 trucks and more than 8,000 employees. Emery Worldwide, just five years ago considered the weak link in the CF family stands today as the jewel in the company's crown.

<div class="phx-topic">Zim Integrated Shipping Services must pay Samsung Electronics $3.7 million in damages because the ocean carrier unreasonably held the release of Samsung containers during various billing disputes between the parties over detention and demurrage charges in 2021 and 2022, a judge for the Federal Maritime Commission (FMC) has ruled. In a decision published Wednesday, the FMC judge also rebuked Zim for its billing practices, saying they could run afoul of US shipping laws. When it brought the complaint in October 2022, the South Korean electronics giant originally wanted over $12 million in damages from the D&amp;D charges and additional trucking costs. Samsung said the D&amp;D charges spanned almost 10,000 separate charges on nearly 3,000 containers. Most of those containers moved under carrier haulage or so-called “store door” agreements where Zim was responsible for hiring the trucker. Samsung argued that since it did not hire the drayage driver, it shouldn’t pay any fees when a trucker is delayed in retrieving a container. However, the judge determined that many of those charges related to Samsung’s inability to receive cargo at the time. Samsung asked Zim about pre-pulling containers out of ports to avoid demurrage charges, the judge’s ruling said, a finding which shows Samsung was aware it could face those charges. Moreover, the judge did not buy Samsung’s argument that it was not the shipper, just the consignee, and should not be responsible for Zim’s charges. The judge determined the shippers were direct affiliates of Samsung, and thus can also be a responsible party in Zim’s service contracts. “It cannot be categorically found that all D&amp;D charges on door/carrier haulage shipments should have been paid by Zim,” the decision read. That was also the case when Samsung itself recommended a trucker to Zim, but the trucker failed to perform, the judge ruled. Zim started to refuse releasing some of Samsung’s containers due to the mounting D&amp;D bills, a practice that Samsung alleged also violated shipping law and incurred further demurrage. The FMC judge ruled that an ocean carrier can hold cargo for unpaid charges. However, many of the unpaid charges ended up being for containers that weren’t Samsung’s or were not otherwise justified or itemized on Zim’s invoices, the judge determined, making the holds unreasonable. While Zim eventually corrected the invoice errors, it “struggled to manage customer-specific invoice requirements and procedures during a very busy period,” the judge said. “The evidence shows significant problems with Zim’s invoicing practices because of billing the wrong party, delays in sending invoices, and inaccuracies or missing information,” the decision read. While there was no evidence these were regular practices, “Zim risks violating the Ocean Shipping Reform Act [of 2022] if this level of inaccurate billing continues,” it added. Natznet Tesfay, speaking at the Journal of Commerce’s Breakbulk and Project Cargo Conference here, said S&amp;P Global’s base expectation is “subdued economic growth,” which would likely keep global container volumes from expanding. <div class="phx-topic">Top trucking and rail carriers are warning that volatility linked to uncertain US tariff policy will lead to weaker volumes on the West Coast in the short term and may negatively impact the second half of the year unless clarity comes soon. Economists in recent weeks have downgraded their forecasts for US gross domestic product (GDP), while ocean carriers are reporting sharp declines in <a href="https://www.joc.com/article/hapag-lloyd-saw-china-bookings-drop-hard-after-us-enacted-tariffs-5990185">bookings from China</a>. Maritime consultancy Drewry earlier Thursday said it expects Asia to North America <a href="https://www.joc.com/article/fallout-from-us-china-trade-war-to-depress-trans-pacific-volumes-drewry-5990686">container volumes</a> to drop 5.5% this year. Knight-Swift Transportation and Union Pacific Railroad (UP), during their respective first-quarter earnings calls this week, said it is important to be nimble with capacity if there is a significant decline in volume crossing the docks at Los Angeles and Long Beach. “Maybe a third [of our customers] are not making any changes because of tariffs … some of our customers that don’t have as much exposure to China,” Adam Miller, CEO of Knight-Swift, said during an earnings call Wednesday. “Then there are [customers] that are more in a ‘wait and see bucket,’ drawing down inventory and living off that. There are also some that have told us that they’ve canceled or stopped ordering from China and figuring out how to adjust their supply chain to avoid the cost.” UP CEO Jim Vena, likewise, said focusing on what the railroad can control is essential for navigating any downturn in Asian imports to the West Coast. “There are still a lot of unknowns related to volumes and the economy, but what I do know is that we are driving efficiency throughout our network,” Vena said on the Thursday earnings call. “We are in a good position and will be agile and responsive as we move forward.” <h3>Adjusting capacity to demand </h3>Knight-Swift said there was an impact on freight volumes in March and April, which fell short of the usual seasonal uptick. The carrier plans to cull its capacity by retaining actively used trucks and selling those that are underutilized and not generating revenue. “We can now turn [underutilized tractors] into capital and sell [them] in what’s been a relatively good used equipment market,” Miller said. “If we see a surge in a market that rebounds, we have flexibility to slow down what we [sell] as we have new tractors that come in.” Meanwhile, any downturn in freight demand may prolong what has already been three years of shippers exerting pricing leverage over carriers during contract negotiations. Knight-Swift reported low- to mid-single-digit percentage increases in January and February contracts, but momentum stalled as trade tensions escalated in March. “If we’re able to get some clarity on trade policy, [maybe we] see some seasonality in June that helps offset maybe some of the unseasonable weakness we will see in May,” said Miller. “That’s really the question: How do things play out in June? There’s a lot of ways that this could play out, but we’re watching it really closely and trying to position ourselves to navigate it as well as we can.” <h3>Agile on the rails </h3>Union Pacific anticipates weakness in the international intermodal market for the remainder of the year due to global trade tensions and West Coast market share losses to East Coast ports following the end of labor woes in the latter. “The best thing we can do is just have all the products that we have, a strong service product, and stay close to our customers because we’ve been seeing these supply chain patterns change at the drop of a hat,” said Kenny Rocker, UP’s executive vice president of sales and marketing. The railroad outlined operational strategies if a steep decline in West Coast imports persists. First, UP would take locomotives and railcars out of service that aren’t being utilized. Second, the railroad would consolidate loads on less popular inland routes, running fewer but fully loaded trains. Finally, UP would explore opportunities to mix containers alongside other non-containerized freight traveling to the same destination. Those measures would help reduce operational costs to offset the revenue lost from less cargo moving inland. Still, UP might be hesitant to pull too much capacity out of the market because it remains bullish on domestic intermodal and there are opportunities to take freight away from trucking. The world of LTL is slow to embrace change. Business anachronisms permeate current supply chain processes. These vestiges of the way things used to work define the LTL freight transportation procurement process of many modern shippers.David Knuth, logistics specialist at IEWC, a global supplier of cable and wire based in Wisconsin, is happy to have modernized the RFP process, automating the entire LTL bidding procedure with Bid$ense, SMC³’s automated truckload and LTL freight transportation sourcing solution. But when prompted, he can still recall what once was.In his previous job, a large part of his duties were consumed by creating an intermodal bid package for carriers. In a spreadsheet, Knuth detailed the company’s volumes lane by lane, taking care to delete any errant keystrokes or misleading data. He would then email out the information to each carrier, taking time to respond to detailed technical questions about the spreadsheet data. Finally, he had to compile all the results, create an algorithm that would compare the carriers on each lane, and award the business.“It was a huge undertaking. It took about four months to do,” Knuth said of the old process. “It was almost a full-time job for that part of the year, every year.”In his new job at IEWC, he sat down with Bid$ense on day one and was amazed at the capabilities. Knuth had never before used a bid tool. SMC³’s latest versions of Bid$ense automate the process even further, taking truckload and LTL RFPs entirely online. The tool draws on RFP best-practices protocols to streamline the bidding communication process, enabling bidding carriers to respond accurately and promptly to shipper requests. The solution also does all the distribution work automatically, electronically submitting shipper bid data to carriers based on their actual service capabilities and performance records. Carriers are alerted with timely prompts for RFP deliverables, so shippers aren’t waiting by the phone for responses.Another benefit of automating the process is the data-cleansing assistance. When Knuth sent spreadsheets to carriers, data errors might cloud the bidding process; he might have to resend data or simply accept a price that did not truly reflect the costs of doing business. Data cleansing is incredibly beneficial, he said.The spreadsheet technique also made bidding analysis an onerous task. Since Bid$ense automates and streamlines the entire RFP process, intensive examination is now simple. SMC³ knows that each bid has more than one best outcome. With uniform responses from each carrier, shippers can quickly rank results and create an unlimited quantity of what-if scenarios to make the optimal procurement decision.Jesse Burnett of Central Garden &amp; Pet experiences many of the same benefits. Founded in 1980, Central Garden &amp; Pet has spent the last three decades growing from a small garden supply company to a provider of a range of products from dog chews and bird seed to soil supplements and natural insecticides. For much of its life, the company shipped these disparate goods via LTL and truckload carriers to retailers throughout the country, relying on each business unit to negotiate directly with their freight transportation providers. This arrangement worked fairly well for a small company, but as Central Garden &amp; Pet expanded, leadership decided to consolidate decision making.Burnett helped centralize the transportation decision making in 2015 with SMC³’s Bid$ense. Before Bid$ense, every business unit operated independently as far as negotiating with carriers.“There were a lot of different things just floating around,” he said. “We didn’t have master agreements in place; no national pricing at all. The pricing from carriers was just all over the place, depending on where you were.”The transformations he saw with Bid$ense were immediate. Burnett has been using the tool about every other year since its implementation at the company. Central Garden and Pet’s $19.6 million 2019 LTL bid saved the company just more than 9 percent when compared to its historical average. For Burnett, though, bid automation extends far beyond savings.“We knew that we weren’t getting the best pricing offer from our carriers just because nothing was centralized,” he continued. “We knew that if we combined everything from all these business units and paired it with one corporate offering, then it would drive some cost benefit with it.”When the company initially decided to centralize bid procurement, executives researched a number of different methodologies and technologies. In the end, though, Burnett found that Bid$ense was both widespread and well known, and that his carrier partners already knew how to use the application. Burnett also highlighted the data-cleansing process as a major benefit, saying the rigorous process ensures that carriers always return the best price.“It definitely has helped drive savings,” he said. “Any time you go out there and you drive that competitiveness with the carriers and they know they’re in a bid environment, it seems to sharpen their pencils.”Transportation procurement is an integral part of the modern supply chain. With Bid$ense, shippers can develop a strategic implementation plan that saves them time and money, but also helps them create strong relationships with their carrier partners. These carriers appreciate the solution’s data-cleansing process; when carriers receive a complete shipment history and future volume forecast, they don’t have to guess on pricing. The reliance on e-commerce has ballooned since the start of the pandemic, and last-mile LTL shipments and related e-commerce strains on the supply chain won’t diminish once social distancing abates. That genie isn’t going back into the bottle. So supply chain employers need logistics workers that are fully versed in all aspects of the industry, ready to solve unique shipping and delivery problems based on their extensive supply chain knowledge But why care about LTL? It’s been reported that some shippers in today’s world are no longer concerned with what mode is used to ship their goods.
