The manufacturers — Cheetah Chassis and Stoughton Trailers — contend that the same trade practices that led to an influx of low-cost Chinese chassis are now occurring with imports from the other three nations, causing significant financial harm to US producers. The petition seeks antidumping duties of 32.37% on Mexico, 234.06% on Thailand and 304.68% on Vietnam, although it does not specify how those figures were calculated. “While the sources of dumped and subsidized imports have shifted, they still have the same effect: taking domestic market share and eroding a proud American manufacturing industry,” said Robert DeFrancesco, an attorney representing the manufacturers. The companies argue that the trade practices used by the foreign chassis makers prevented Cheetah and Stoughton from securing business in 2021 and 2022, when a shortage of chassis disrupted the US supply chain and caused demand to soar. “This pervasive underselling caused domestic producers to lose sales and revenue,” the complaint, filed Wednesday, alleges. “Customers cut off contracts early in favor of [foreign] imports, and US producers were forced to either lower prices further or lose additional sales. Moreover, as demand softens, [foreign] producers will have even more incentive to offer chassis at even lower prices to win the remaining available sales.” If levied, the duties would hurt manufacturers that include ATRO Trailers and GG Trailers in Mexico, THACO Industries in Vietnam and CIE Manufacturing in Thailand. <h3>Protracted battle with CIE </h3>The allegations are the latest chapter in a five-year battle between US chassis manufacturers and CIE, formerly known as CIMC Intermodal, a subsidiary of China International Marine Containers (CIMC). CIE was the target of the original <a href="https://www.joc.com/article/crippling-duty-on-chinese-chassis-upheld-in-final-ruling-5249958">antidumping and countervailing duties</a> on Chinese chassis in May 2021 after a year-long investigation. Shortly thereafter, CIE opened a new factory in Thailand to avoid the new tariffs. In 2022, CIE filed a complaint <a href="https://www.joc.com/article/us-commerce-department-rejects-pitts-appeal-in-marine-chassis-case-5200425">against Pitts Enterprises</a>, alleging that chassis built by Vietnam-based THACO Industries were in fact Chinese-made. Investigators ruled in 2023 that Pitts had violated US trade laws. That same year, US manufacturers alleged that chassis produced by CIE in Thailand contained <a href="https://www.joc.com/article/us-cbp-clears-chassis-maker-cie-in-case-alleging-tariff-evasion-5214408">Chinese parts</a>. Investigators determined in 2024 that those allegations were unfounded. “Yet again we will rigorously refute these baseless claims and will work with the appropriate agencies on reform so a select few cannot continue to weaponize these regulatory levers for commercial gain with no recourse,” Trevor Ash, CEO of CIE Manufacturing, said in a statement to the Journal of Commerce. In a letter to customers on Thursday, CIE warned that the proposed duties could increase the average price of a chassis by 75% and create a production shortage that would strain beneficial cargo owners, chassis lessors and drayage providers. <h3>An uphill battle this time around </h3>While CIE prevailed in previous trade disputes in 2023 and 2024, it may face a more challenging landscape this time. President Donald Trump has repeatedly criticized foreign trade practices that he argues harm US manufacturing and said he will implement new tariffs on China, Canada, Mexico and the European Union. The Office of the US Trade Representative has discussed <a href="https://www.joc.com/article/us-port-tax-would-scramble-ocean-services-raise-shipper-costs-drewry-5952046">charging fees of up to $1 million</a> for Chinese-operated vessels calling at US ports. In the final weeks of the Biden administration, the Defense Department added COSCO Shipping and CIMC to its sanctions list for alleged ties to the Chinese military. The Commerce Department is expected to decide within 20 days whether to initiate an investigation on the allegations brought by Cheetah and Stoughton, while the International Trade Commission (ITC) must issue a preliminary determination on material injury within 45 days. The ITC’s ruling will be critical. The commission has the authority to impose preliminary antidumping and countervailing duties while an investigation is ongoing. The companies argue that the trade practices used by the foreign chassis makers prevented Cheetah and Stoughton from securing business in 2021 and 2022, when a shortage of chassis disrupted the US supply chain and caused demand to soar. “This pervasive underselling caused domestic producers to lose sales and revenue,” the complaint, filed Wednesday, alleges. “Customers cut off contracts early in favor of [foreign] imports, and US producers were forced to either lower prices further or lose additional sales. Moreover, as demand softens, [foreign] producers will have even more incentive to offer chassis at even lower prices to win the remaining available sales.” If levied, the duties would hurt manufacturers that include ATRO Trailers and GG Trailers in Mexico, THACO Industries in Vietnam and CIE Manufacturing in Thailand. Protracted battle with CIE The allegations are the latest chapter in a five-year battle between US chassis manufacturers and CIE, formerly known as CIMC Intermodal, a subsidiary of China International Marine Containers (CIMC). CIE was the target of the original antidumping and countervailing duties on Chinese chassis in May 2021 after a year-long investigation. Shortly thereafter, CIE opened a new factory in Thailand to avoid the new tariffs. In 2022, CIE filed a complaint against Pitts Enterprises , alleging that chassis built by Vietnam-based THACO Industries were in fact Chinese-made. Investigators ruled in 2023 that Pitts had violated US trade laws. That same year, US manufacturers alleged that chassis produced by CIE in Thailand contained Chinese parts . Investigators determined in 2024 that those allegations were unfounded. “Yet again we will rigorously refute these baseless claims and will work with the appropriate agencies on reform so a select few cannot continue to weaponize these regulatory levers for commercial gain with no recourse,” Trevor Ash, CEO of CIE Manufacturing, said in a statement to the Journal of Commerce. In a letter to customers on Thursday, CIE warned that the proposed duties could increase the average price of a chassis by 75% and create a production shortage that would strain beneficial cargo owners, chassis lessors and drayage providers. An uphill battle this time around While CIE prevailed in previous trade disputes in 2023 and 2024, it may face a more challenging landscape this time. President Donald Trump has repeatedly criticized foreign trade practices that he argues harm US manufacturing and said he will implement new tariffs on China, Canada, Mexico and the European Union. The Office of the US Trade Representative has discussed charging fees of up to $1 million for Chinese-operated vessels calling at US ports. In the final weeks of the Biden administration, the Defense Department added COSCO Shipping and CIMC to its sanctions list for alleged ties to the Chinese military. The Commerce Department is expected to decide within 20 days whether to initiate an investigation on the allegations brought by Cheetah and Stoughton, while the International Trade Commission (ITC) must issue a preliminary determination on material injury within 45 days. The ITC’s ruling will be critical. The commission has the authority to impose preliminary antidumping and countervailing duties while an investigation is ongoing. In actual dollar terms, that means carriers are asking for $2,000 per FEU to the West Coast and $3,000 per FEU to the East Coast for next year’s contracts, most of which start on May 1. “The feeling is that $2,000/$3,000 is achievable,” Benton Kauffman, head of trans-Pacific air and sea logistics at the forwarder DSV Global Transport Logistics, told the Journal of Commerce. Carriers are trying to avoid a repeat of last spring, when they believe they underpriced their services, settling at West Coast rates of $1,500 to $1,600 per FEU and East Coast rates at $2,500 to $2,600 per FEU for 2024–25 contracts. Most large and midsize importers have wrapped up the first round of their 2025–26 service contract negotiations and intend to finalize the agreements in the coming month, according to forwarders in the eastbound trans-Pacific, the largest US trade lane. “Most of our clients want to wrap up by the end of March,” Kauffman said. If midsize BCOs are signing contracts at $2,000/$3,000 per FEU, the several largest retailers may lose bargaining power if they insist on paying $1,200-$1,400 for the West Coast and $2,200-$2,400 to the East Coast, Tejwani said. “That may put a reverse pressure on the larger big-box retailers,” he said. Rather than waiting until later in March to finalize the contract, he is ready in the coming week to present a final offer that will cover as much as 60% of the total volume the company plans to import in the coming year. The remaining 40% will then be spread out over several carriers and NVOs. “We used to worry about putting too many eggs into one basket, but this carrier has done a great job for us,” the importer said. <h3>Some retailers going slow in contract talks </h3>On the other hand, some importers are in no rush to finalize their contract negotiations because the general feeling among shippers and analysts is that while supply and demand will return to normal seasonal levels in March as factories in Asia return to full production after the Lunar New Year lull, import growth this year will be down considerably from last year. US imports from Asia were up 12.7% in January year over year after growing 17.6% in 2024 from 2023, according to PIERS, a Journal of Commerce sister company within S&amp;P Global. Ben Coleman, president of the NVO Teampower Logistics, said that while space is always a concern for importers, vessel capacity is scheduled to increase about 10% while import volume growth will likely be in the mid-single digits. “A number of BCOs don’t want to rush into this,” Coleman said. Spot pricing in the eastbound trans-Pacific also plays a role in pricing annual service contracts, and the spot market has been dropping rapidly during the Lunar New Year lull. The West Coast spot rate as of Feb. 27 was $2,450 per FEU, down 11% on the week and 37% year over year. The East Coast spot rate of $3,575 per FEU is down 9% week over week and 38% year over year, according to PIERS, a sister product of the Journal of Commerce within S&amp;P Global. <div class="wrapper-narrow"><dynamic-object type="jocchartid" resource-id="e7a65aab-9aac-4f07-9b74-1793746c01ef"></dynamic-object></div>Carriers have filed general rate increases (GRIs) effective March 1 and March 15 with the intention of propping up spot rates during contract negotiations. But there is widespread skepticism whether the GRIs will stick, especially because some carriers are undercutting current spot rates with special “bullet” rates below $2,000 to the West Coast. “We’re already starting to see a few carriers being very aggressive in their pricing,” an NVO said. <h3>GRIs losing significance? </h3>Kauffman said that GRIs have lost much of the significance they had in past years because carriers have been successful in propping rates up through peak season surcharges (PSSs). PSSs are added to customers’ contract rates by mutual consent of the carrier and the importer. In the past, PSSs were levied during the peak volume months of August through October, but they are now a year-round tactic deployed by carriers to prop up rates. “PSSs have replaced the GRI,” Kauffman said. “We don’t like it, but we’re explaining this to our customers.” Despite the significant uncertainties facing the trans-Pacific trade this year, notably the Trump administration’s tariffs and their impact on consumer demand, and the eventual return of commerce through the Suez Canal that would likely result in a surge of overcapacity, retailers will have to agree on contract pricing soon because seasonal and special-event shipments continue to be shipped, noted an industry consultant who was formerly a logistics manager at big-box retailers. “You can pause some of your merchandise, but not all of it,” the source said. The world of LTL is slow to embrace change. Business anachronisms permeate current supply chain processes. These vestiges of the way things used to work define the LTL freight transportation procurement process of many modern shippers.David Knuth, logistics specialist at IEWC, a global supplier of cable and wire based in Wisconsin, is happy to have modernized the RFP process, automating the entire LTL bidding procedure with Bid$ense, SMC³’s automated truckload and LTL freight transportation sourcing solution. But when prompted, he can still recall what once was.In his previous job, a large part of his duties were consumed by creating an intermodal bid package for carriers. In a spreadsheet, Knuth detailed the company’s volumes lane by lane, taking care to delete any errant keystrokes or misleading data. He would then email out the information to each carrier, taking time to respond to detailed technical questions about the spreadsheet data. Finally, he had to compile all the results, create an algorithm that would compare the carriers on each lane, and award the business.“It was a huge undertaking. It took about four months to do,” Knuth said of the old process. “It was almost a full-time job for that part of the year, every year.”In his new job at IEWC, he sat down with Bid$ense on day one and was amazed at the capabilities. Knuth had never before used a bid tool. SMC³’s latest versions of Bid$ense automate the process even further, taking truckload and LTL RFPs entirely online. The tool draws on RFP best-practices protocols to streamline the bidding communication process, enabling bidding carriers to respond accurately and promptly to shipper requests. The solution also does all the distribution work automatically, electronically submitting shipper bid data to carriers based on their actual service capabilities and performance records. Carriers are alerted with timely prompts for RFP deliverables, so shippers aren’t waiting by the phone for responses.Another benefit of automating the process is the data-cleansing assistance. When Knuth sent spreadsheets to carriers, data errors might cloud the bidding process; he might have to resend data or simply accept a price that did not truly reflect the costs of doing business. Data cleansing is incredibly beneficial, he said.The spreadsheet technique also made bidding analysis an onerous task. Since Bid$ense automates and streamlines the entire RFP process, intensive examination is now simple. SMC³ knows that each bid has more than one best outcome. With uniform responses from each carrier, shippers can quickly rank results and create an unlimited quantity of what-if scenarios to make the optimal procurement decision.Jesse Burnett of Central Garden &amp; Pet experiences many of the same benefits. Founded in 1980, Central Garden &amp; Pet has spent the last three decades growing from a small garden supply company to a provider of a range of products from dog chews and bird seed to soil supplements and natural insecticides. For much of its life, the company shipped these disparate goods via LTL and truckload carriers to retailers throughout the country, relying on each business unit to negotiate directly with their freight transportation providers. This arrangement worked fairly well for a small company, but as Central Garden &amp; Pet expanded, leadership decided to consolidate decision making.Burnett helped centralize the transportation decision making in 2015 with SMC³’s Bid$ense. Before Bid$ense, every business unit operated independently as far as negotiating with carriers.“There were a lot of different things just floating around,” he said. “We didn’t have master agreements in place; no national pricing at all. The pricing from carriers was just all over the place, depending on where you were.”The transformations he saw with Bid$ense were immediate. Burnett has been using the tool about every other year since its implementation at the company. Central Garden and Pet’s $19.6 million 2019 LTL bid saved the company just more than 9 percent when compared to its historical average. For Burnett, though, bid automation extends far beyond savings.“We knew that we weren’t getting the best pricing offer from our carriers just because nothing was centralized,” he continued. “We knew that if we combined everything from all these business units and paired it with one corporate offering, then it would drive some cost benefit with it.”When the company initially decided to centralize bid procurement, executives researched a number of different methodologies and technologies. In the end, though, Burnett found that Bid$ense was both widespread and well known, and that his carrier partners already knew how to use the application. Burnett also highlighted the data-cleansing process as a major benefit, saying the rigorous process ensures that carriers always return the best price.“It definitely has helped drive savings,” he said. “Any time you go out there and you drive that competitiveness with the carriers and they know they’re in a bid environment, it seems to sharpen their pencils.”Transportation procurement is an integral part of the modern supply chain. With Bid$ense, shippers can develop a strategic implementation plan that saves them time and money, but also helps them create strong relationships with their carrier partners. These carriers appreciate the solution’s data-cleansing process; when carriers receive a complete shipment history and future volume forecast, they don’t have to guess on pricing. If there’s one immutable truth in the world of logistics, it’s this: LTL is an inherently complex form of transportation. Dedicated LTL study is a necessity, not a luxury. At the same time, changes in LTL and the broader supply chain world are accelerating. The reliance on e-commerce has ballooned since the start of the pandemic, and last-mile LTL shipments and related e-commerce strains on the supply chain won’t diminish once social distancing abates. That genie isn’t going back into the bottle. So supply chain employers need logistics workers that are fully versed in all aspects of the industry, ready to solve unique shipping and delivery problems based on their extensive supply chain knowledge But why care about LTL? It’s been reported that some shippers in today’s world are no longer concerned with what mode is used to ship their goods. A Multimodal Approach Ensures On-Time Delivery This mode agnosticism means supply chain stakeholders have to be well versed in all modes of transportation. As unforeseen weather events and other disruptions, such as protests, become more common, savvy logistics employees will need to be armed with familiarity of all modes, not just the most popular, to ensure that freight is delivered on time, without damage, and in the most financially expedient way possible.
